Terms Of Service
You must read all of this in its entirety before commissioning meUnless previously discussed, commissioning me means agreeing to the entirety of these terms of service, any part of them can be
subject to change if talked about beforehand

I. GENERAL TERMS.
READ THE ToS ON ITS ENTIRETY
Please write in a clear and nice manner.
Provide any number of references, this includes, ref sheets, drawings, a guide for pose/enviroment (any quality is completely OK).
When the piece has the image or characters of someone other than the commissioner, the responsability to get the consent of the other parties to appear in the piece is on the commissioner, if the commission is intended as a gift, they must know for certain the other party/parties is comfortable with their image or characters being used.
Any ill behaviour, either to me, or to other people will not be tolerated and your commission will be canceled if it occurs.
If you fail to follow the rules provided I have the right to decline your commission.II. PAYMENT
All commissions must all be paid in full after sketch is approved
The only accepted currencies are USD (United States Dollar) and COP (Colombian Peso) with the given currency conversion.
Payment can be processed through Ko-Fi, PayPal [SUBJECT TO CHANGE, THE P SITE IS GETTING ALMOST UNUSABLE DUE TO FEES] or other money-sharing services, the choice is of the commissionser.III. PROCESS
Work in progress images will be sent at multiple stages to double check on character design, pose, background and foreground elements, these WIPs will not be provided in a YCH.
The time for your commission to be completed can be up to 2 weeks, depending on many factors such as;
personal health, your spot in the queue, complexity of the piece, work, school or family issues.
If any of the things stated above occurs you will be notified asap.
The work will be delivered via WeTransfer link with the fully finished piece, a flat-color version (when applicable), and the .CLIP file.IV. CUSTOMER SATISFACTION
I will do everything I can to make my customers happy, this includes modifications to the piece.
When in the process of approving the sketch, and if the commissioner has not provided them i will supply several "Thumbnails" to have an idea of the pose/enviroment and to focus in on a good design, here is where most of the changes can and will happen, and along the process, the impact of changes will reduce (Slight pose adjustment on sketch phase, resizing limbs and accessories, adding an accessory).
These changes come in no extra cost, as i want to make a piece that satisfies the customer.
Any great changes after approving the sketch will come with an extra charge, such as an outfit change, major outfit addition or subtraction, background change or anything that makes me have to redraw it completely.
I will make sure to check in with the commissioner via wips through direct messages to check that the commission is going the right way.V. COPYRIGHT / USAGE POLICY
I, the artist, hold every right to the produced drawing, not the commissioner, therefore I´m allowed to use the copyrighted artwork in any way, for example;
Promoting myself commercially, both in person and online
Publish books with the art
Display it anywhere, both in a commercial and non-commercial way
Of course, always crediting and linking back to the character owner(s) whenever possibleThe commissioner is allowed to:
Use the copyrighted artwork for personal use only (unless agreed otherwise)
Print the art, and claim the right of their character(s) but not the drawing itself.
Use the art to promote themselves with proper credit given to me.
Post the artwork on any social media with proper credit given to me
If you break the copyright infringement in any way, every right you had to the drawing will be retracted.The following is considered Copyright infringement:Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way, THIS INCLUDES MINTING/TOKENIZING IT AS CRYPTOART/NFT REGARDLESS OF CURRENCY)
Taking Credit for the creation of the artwork.
Removing any watermarks/signatures.
altering the artwork without my consent.A Purchase of Commercial rights to the artwork will always be 200% of original price.
With commercial rights you are allowed to:
make any sort of merch with the artwork.
Use it in books, covers, or as Props.
Change it to your liking and promote your own brand with.
Credit is still required for usage of the artwork, even if altered or edited.VI. CANCELING/REFUNDING POLICY
I have the right to cancel and refund the money for your commission at any time.
Once the money has exchanged hands, you have no right to cancel or demand a refund from me under any circumstances.
If the money has not been sent yet the commissioner has the right to cancel the commission.
If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.
You will forbidden to ever commission me ever again.
Your name will be publicly posted everywhere I want to for others to watch out for.
I also have every right to file a complaint wherever possible.
